Digitalisation in labour law - paper employment record books shall become history
On 26.09.2023 the National Assembly adopted at second voting an Act to amend the Labour Code (“AALC”)

The changes concern the establishment of a national employment register. In this register the authorities would enter and maintain the uniform electronic employment records ("UEER") of each employee. The said UEER represents an official certification document containing data and circumstances relating to the employee’s labour activity and is intended to replace the paper employment record books.

 

The contents of the UEER are specified by the amendments, i.e. the records should indicate the key elements of the labour relation, including: personal data of the employee; details of the commencement and duration of the employment contract; the amount of remuneration agreed upon; working hours; agreed paid annual leave; details of terminated employment contracts, including the date and legal grounds for termination, etc.

 

The employees shall have the right to access information concerning their UEER, including the history of accesses made by third parties, except those made by the authorities of the preliminary penal proceedings and the State Agency for National Security.

 

The employers shall have the right to access information from the employment register regarding their employees, entered by previous employers. The specific content of the information and the procedure by which employers will have access to it shall be laid down in a separate regulatory act.

 

The promulgation of the AALC in the State Gazette is pending, as most of the changes will enter into force on 01.06.2025.
